HUSH HOLIDAY LTD

BOOKING TERMS & CONDITIONS

Updated: 5 October 2026

These Booking Terms & Conditions apply to direct bookings for:

Bosun’s Call
First Floor Flat
26 Fairfax Place
Dartmouth
Devon
TQ6 9AB

and

Seaview Palms
4 Whiteladies
Stoke Fleming
Dartmouth
Devon
TQ6 0NR

Both properties are operated by Hush Holiday Ltd, referred to in these terms as “we”, “us” or “our”.

Please read these terms carefully before booking. When we accept your booking, a legally binding contract is created between Hush Holiday Ltd and the person making the booking on behalf of the holiday party.

1. Your booking

The person making the booking is the party leader and must be at least 18 years old.

By making a booking, the party leader confirms that:

  • they are authorised to make the booking on behalf of everyone staying at the property

  • everyone in the party agrees to comply with these Booking Terms & Conditions

  • the information supplied when booking is accurate

  • they accept responsibility for payments due under the booking

  • they will make all members of the party aware of these terms and any relevant property or safety information.

The maximum permitted occupancy at either property is four guests plus one infant using a travel cot, unless we have specifically agreed otherwise in writing.

Children and infants count as members of the holiday party for booking and safety purposes.

The property must not be occupied by more people than stated on the booking confirmation without our prior agreement.

2. When your booking becomes confirmed

Submitting a booking request or making an initial payment does not by itself mean that we have accepted the booking.

Your booking becomes confirmed and the contract between us begins when we issue written confirmation by email.

We reserve the right to decline a booking before confirmation. If we decline a booking, any money already paid to us will be refunded promptly.

Please check your booking confirmation carefully and tell us as soon as possible if anything is incorrect.

It is your responsibility to provide us with a valid email address and telephone number and to monitor communications relating to your booking.

3. Bookings made through third-party platforms

If you book Bosun’s Call or Seaview Palms through a third-party booking platform such as Airbnb or Booking.com, that platform’s booking, payment and cancellation conditions may also apply.

Where there is a conflict between these terms and specific payment or cancellation terms forming part of your confirmed booking through a third-party platform, the terms shown and accepted through that platform will normally take precedence in relation to that particular matter.

4. Prices

Prices are charged for the property rather than per person unless clearly stated otherwise.

Before a direct booking is confirmed, we will show you the total price payable for the booking, including any mandatory charges that can be calculated at that stage.

Any applicable taxes and compulsory charges will be included or clearly identified before the booking is completed.

We do not charge an additional fee simply because you pay by debit or credit card.

All direct-booking payments are made in pounds sterling.

If you make an international bank transfer, you are responsible for ensuring that any bank charges or exchange-rate deductions do not reduce the amount received by us.

5. Payment

For bookings made more than eight weeks before the arrival date, a 25% booking deposit is payable when the booking is made.

The remaining 75% balance is due no later than eight weeks before the arrival date.

For bookings made within eight weeks of arrival, the full booking price is payable when the booking is made.

The 25% booking deposit forms part of the total price of your holiday. It is not an additional fee.

Payment may be made using the payment methods offered through our booking system, including debit or credit card or, where agreed, bank transfer.

If payment of the balance is not received by the due date, we will normally contact you and give you a reasonable opportunity to make payment.

If payment remains outstanding after a reminder, we may treat this as cancellation of the booking by you. Any sums retained or subsequently claimed will be subject to the cancellation provisions below and will not exceed the loss we are reasonably entitled to recover.

6. Cancellation by you

We strongly recommend that you arrange suitable travel insurance when making your booking. Your insurance should, where appropriate, provide cover for cancellation due to illness, accident, bereavement, travel disruption and other circumstances that could prevent you from travelling.

Cancellations must be made in writing using the contact details shown on your booking confirmation.

Your cancellation takes effect on the date we receive your written notice.

For direct bookings, the following maximum cancellation charges normally apply:

Notice received before arrival Maximum cancellation charge
More than 56 days Up to 25% of the total booking price
29–56 days Up to 50% of the total booking price
15–28 days Up to 100% of the total booking price
14 days or fewer Up to 100% of the total booking price
Failure to arrive without cancellation Up to 100% of the total booking price

These percentages are maximum charges rather than automatic penalties.

We will take reasonable steps to reduce our loss, including making cancelled dates available for re-booking where reasonably practicable.

If we re-let your cancelled dates

If all or part of the cancelled stay is successfully re-let, we will take the replacement booking into account when calculating our actual loss.

Any refund due will reflect:

  • money recovered from the replacement booking

  • any difference between the original booking price and the replacement booking price

  • reasonable additional administration or re-marketing costs arising from the cancellation

  • any other direct costs or losses that cannot reasonably be recovered.

We will not seek to recover the same loss twice.

If our actual recoverable loss is lower than the cancellation charge shown in the table above, the lower amount will apply.

Refunds will normally be made using the original payment method wherever reasonably practicable.

Personal circumstances such as illness, bereavement, vehicle breakdown, transport disruption or adverse weather do not automatically entitle you to a refund where the property remains available for your stay. This is one of the reasons we strongly recommend appropriate travel insurance.

7. Cooling-off period

Bookings for holiday accommodation provided on specific dates do not normally benefit from the standard 14-day cancellation period that applies to many online purchases under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Your cancellation rights are therefore governed by these Booking Terms & Conditions and any additional rights you may have under applicable consumer law.

8. Changes requested by you

If you would like to change your booking, please contact us as soon as possible.

Changes are subject to availability and are not guaranteed.

Possible changes may include:

  • extending your stay

  • changing your arrival or departure dates

  • adding guests up to the property's permitted maximum occupancy

  • removing guests from the booking.

Because our prices are generally charged per property rather than per person, reducing the number of guests will not normally result in a reduction in the booking price.

If a requested change results in a higher accommodation price, the difference will be payable.

If you ask to move your booking to different dates, we may treat the request as a cancellation and new booking where the change would cause us a significant financial loss, particularly where the request is made close to the original arrival date.

We will explain any additional charge before agreeing to the change.

A change is only confirmed when we confirm it to you in writing.

9. Changes or cancellation by us

We do not expect to have to change or cancel confirmed bookings but occasionally circumstances may make this necessary.

If we need to make a significant change, we will tell you as soon as reasonably practicable.

Where a significant change materially affects your stay, you may choose to:

  • accept the change

  • accept suitable alternative accommodation if we are able to offer it, or

  • cancel the booking and receive a refund for accommodation that we are unable to provide.

If we have to cancel your booking for reasons that are our responsibility, we will refund payments made for accommodation we cannot provide.

Nothing in these terms limits any additional rights you may have under consumer law.

We will not be responsible for losses that could not reasonably have been foreseen when the booking was made or for losses arising from circumstances outside our reasonable control, except where the law requires otherwise.

10. Circumstances beyond our reasonable control

Sometimes events outside our reasonable control can affect a holiday.

These may include, for example:

  • fire or flood

  • severe weather

  • natural disaster

  • epidemic or pandemic

  • war, terrorism or civil disturbance

  • government action or legal restrictions

  • significant failure of essential utilities

  • major transport or infrastructure disruption

  • emergency building or utility works

  • serious damage to the property

  • other similar circumstances that could not reasonably have been prevented.

  • Spiders, rural and coastal properties attract spiders and cobwebs, their presence does not mean the property is unclean, many can arrive and spin webs after the cleaners have finished their work.

If circumstances beyond our reasonable control mean that we cannot provide the property for your booked stay, we will contact you as soon as reasonably practicable.

Where the accommodation cannot be provided and the booking must be cancelled, payments made for accommodation that will not be supplied will be refunded, subject to any different legal remedy applying in the particular circumstances.

We will not normally be responsible for additional or consequential costs such as travel costs, alternative accommodation arrangements or other holiday expenses where the cancellation results from circumstances genuinely outside our reasonable control, except where the law provides otherwise.

If the property remains available but you are unable to travel, for example because of illness, transport problems, weather affecting your journey or other personal circumstances, this will normally be treated as a cancellation by you under section 6.

Again, we strongly recommend appropriate travel insurance.

11. Use of the properties

Bosun’s Call and Seaview Palms are provided as short-term holiday accommodation.

Your booking does not create a landlord and tenant relationship or give you any right to occupy the property beyond the confirmed holiday period.

The properties must not be:

  • sublet

  • re-sold

  • transferred to another party without our permission

  • used for illegal purposes

  • used to hold parties or events

  • used as workforce, crew or contractor accommodation

  • used for commercial activities involving visitors or customers.

Incidental remote working during your holiday is permitted.

We do not accept stag parties, hen parties or other party or event bookings.

We reserve the right to decline a booking where we reasonably believe that the intended use is incompatible with the property, its neighbours or these Booking Terms & Conditions.

Bookings will not be restricted because of the sex, sexual orientation, race, religion, disability or another protected characteristic of the guests.

12. Behaviour and consideration for neighbours

Both properties are located within residential communities.

Guests must behave responsibly and show reasonable consideration to neighbours and other residents.

Please keep noise to a reasonable level at all times and particularly between 10pm and 8am.

Illegal, threatening, seriously antisocial or persistently disruptive behaviour will not be tolerated.

We may require guests to leave where there is a serious breach of these terms, illegal behaviour, significant disturbance to neighbours or a reasonable risk of significant damage to the property.

If your stay is ended because of a serious breach by you or a member of your party, any refund will be determined taking into account the circumstances and the reasonable loss suffered by us.

13. Arrival and departure

Check-in at both properties is from 3pm unless otherwise agreed.

Check-out is:

Bosun’s Call – by 10am

Seaview Palms – by 11am

Guests must leave the property by the stated departure time so that our housekeepers have sufficient time to prepare it for incoming guests.

If an unauthorised late departure causes us additional cleaning, staffing or guest-relocation costs, we may seek to recover the reasonable additional cost incurred.

If you expect to arrive significantly later than planned, please let us know.

If you have not arrived by noon on the day following your scheduled arrival and we have been unable to contact you, we may reasonably assume that you will not be taking up the booking.

14. Looking after the property

Please treat the property and its contents with reasonable care.

You are expected to:

  • leave the property in a reasonably clean and tidy condition

  • look after furniture, fittings and appliances

  • report significant damage or breakages as soon as reasonably practicable

  • secure windows and external doors when leaving the property unattended

  • follow any reasonable safety information supplied to you.

Normal wear and tear is not chargeable.

You will be responsible for reasonable costs arising from damage, breakages, missing items or excessive cleaning caused by you, members of your party or visitors you have permitted at the property.

Any claim will be based on the reasonable cost of cleaning, repair or replacement rather than an arbitrary penalty.

We may provide photographs, invoices or other reasonable evidence supporting a claim where appropriate.

Small accidental breakages happen. Please tell us about them promptly so that we can deal with them fairly.

15. Access during your stay

We respect your privacy during your holiday.

However, we or our authorised representatives may need to enter the property where reasonably necessary for:

  • an emergency

  • urgent repairs

  • safety or security concerns

  • preventing significant damage

  • investigating a serious complaint relating to the property or its occupation

  • complying with a legal obligation.

Except in an emergency or where immediate access is reasonably necessary, we will try to contact you before entering.

16. Smoking, vaping, candles and fire safety

Smoking, vaping and the use of e-cigarettes are not permitted inside either property or within internal communal areas.

Candles, tea lights and other naked flames are not permitted.

Guests must not interfere with smoke alarms, carbon monoxide alarms, fire equipment or other safety equipment.

Portable cooking equipment, portable heaters and similar high-load or potentially hazardous appliances must not be brought into or used at the property without our prior agreement.

Normal personal electrical items such as mobile phones, laptops and chargers may of course be used responsibly.

17. Bikes and e-bikes

Bicycles and e-bikes must not be stored in a way that blocks escape routes or damages the property.

E-bike batteries must not be charged inside the accommodation unless we have specifically confirmed that an appropriate charging location is available.

Please contact us before arrival if you intend to bring bicycles or e-bikes and require information about suitable storage.

Guests remain responsible for appropriately securing their bicycles. We are not responsible for loss or theft except where caused by our negligence or where the law provides otherwise.

18. Electric vehicles and plug-in hybrid vehicles

Electric vehicle charging is not permitted at either Bosun’s Call or Seaview Palms.

Neither property provides an authorised EV charging facility.

Guests must not charge an electric vehicle or plug-in hybrid vehicle from any electrical socket at either property, including domestic 13-amp sockets, communal sockets, external sockets or sockets accessed using an extension lead.

In particular, the use of a portable domestic EV charging cable, commonly known as a “granny charger”, is strictly prohibited.

Guests must also not run cables through windows, doors or communal areas or connect a vehicle to the electrical supply in any other way.

This restriction is in place for electrical safety, fire safety, insurance and electrical-load management reasons.

Guests requiring vehicle charging should use a suitable public or dedicated EV charging point.

Any unauthorised EV charging may be treated as a serious breach of these Booking Terms & Conditions. Where unauthorised charging causes damage, electrical faults or other costs, we may seek to recover the reasonable costs incurred.

19. Keys and access

You are responsible for keys and other access devices provided during your stay.

If a key or access device is lost, damaged or not returned, we may charge the reasonable cost of replacement, including any necessary locksmith or security costs where reasonably incurred.

Dogs

22. CCTV and security

External CCTV may operate at entrance or security areas associated with the properties where stated.

CCTV will not be installed in private internal living or sleeping areas.

Where CCTV is used, personal information will be handled in accordance with our Privacy Policy and applicable data protection legislation.

23. Personal belongings

Please take reasonable precautions with your personal belongings and secure the property when leaving it unattended.

We are not responsible for loss, theft or damage to personal belongings unless caused by our negligence or where liability cannot legally be excluded.

Guests should ensure that appropriate travel insurance covers valuable belongings taken on holiday.

24. Problems during your stay

We want you to enjoy your stay and will make reasonable efforts to ensure that the accommodation is provided as described.

Holiday properties are domestic properties and occasionally appliances, services or facilities can develop faults.

If something is missing, damaged or not working properly, please contact us as soon as reasonably practicable, preferably while you are still at the property.

Reporting a problem promptly gives us the opportunity to investigate and, where possible, correct it during your stay.

We cannot guarantee an immediate or 24-hour maintenance service but we will take reasonable steps to resolve significant problems as quickly as practicable.

Your legal rights are not affected by this section.

25. Complaints

If you are unhappy with any aspect of the accommodation or our service, please contact us as soon as possible.

Where a problem could reasonably have been reported during the holiday but was not, this may affect our ability to investigate it or provide an appropriate remedy.

However, we will not automatically reject a genuine complaint simply because it was raised after departure.

If a complaint cannot be resolved during your stay, please contact Hush Holiday Ltd using the contact details at the end of these terms.

Nothing in this section removes or restricts your statutory consumer rights.

26. Property descriptions, photographs, weather and character

We make reasonable efforts to ensure that the descriptions, photographs, videos and other information used to advertise Bosun’s Call and Seaview Palms provide a fair and accurate representation of the properties.

Photographs and presentation

Photographs and videos represent the properties at the time they were taken.

As the properties are lived-in holiday homes which are maintained and updated over time, some details may subsequently change. This may include furniture, ornaments, artwork, soft furnishings, bedding, decoration, appliances and the positioning or layout of individual items.

Decorative items shown in photographs are not necessarily guaranteed to be present during your stay.

From time to time we may replace, move or update items because of wear, damage, maintenance or improvements to the property.

These normal changes will not generally constitute a material change to the accommodation provided.

Weather, views and seasonal appearance

Photographs may have been taken during favourable weather conditions and at particular times of the year.

While South Devon can enjoy beautiful sunny weather, we cannot guarantee sunshine, blue skies, temperatures, visibility, sea conditions or any other aspect of the weather during your stay.

The appearance of the surrounding area, views, vegetation and natural light may also vary according to the weather, season and time of day.

Weather conditions do not constitute a change to the accommodation and are outside our control.

Character of the properties

Bosun’s Call and Seaview Palms are individual properties within older buildings and are not purpose-built, standardised hotel accommodation.

Part of their character comes from their age, location and individual construction. Guests should therefore expect some of the features commonly associated with older properties.

These can include variations in floors, walls and ceilings, older architectural details, occasional creaks and noises, differences between rooms, individual layouts and other minor imperfections or irregularities that would not normally be found in newly built or highly standardised accommodation.

These characteristics do not mean that the properties are poorly maintained. We maintain and prepare both properties carefully and aim to provide comfortable, clean and welcoming holiday accommodation.

However, guests looking for completely uniform, newly built or standardised hotel-style accommodation should take the individual character of the properties into account when deciding whether they are suitable for their stay.

Facilities and changes

Furniture, decoration, equipment or other details may change over time and photographs may not show every item currently at the property.

Occasionally a facility, appliance or service may become temporarily unavailable because of maintenance, breakdown or circumstances outside our reasonable control.

If a particular feature, facility, furnishing or other aspect of the property is especially important to your decision to book, please contact us before confirming your booking.

Nothing in this section permits us to materially misdescribe the accommodation or affects your statutory consumer rights where the accommodation supplied is materially different from what was agreed.

27. Liability

Nothing in these Booking Terms & Conditions excludes or limits liability where it would be unlawful to do so.

In particular, we do not exclude liability for:

  • death or personal injury caused by our negligence

  • fraud or fraudulent misrepresentation

  • breach of your statutory consumer rights

  • any other liability that cannot legally be excluded or limited.

Subject to the above, we are not responsible for loss or damage caused by circumstances outside our reasonable control or by the acts or omissions of guests or unrelated third parties.

As the properties are supplied for private holiday use, we are not responsible for business losses including loss of profit, revenue, contracts, business opportunity or business data arising from use of the property for business purposes.

28. Personal information

We need to collect and process certain personal information in order to administer bookings and provide our services.

We process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.

Our Privacy Policy explains, among other things:

  • what personal information we collect

  • why we process it

  • who it may be shared with

  • which service providers may process information on our behalf

  • how long information is retained

  • your data protection rights.

Payment card information is processed through the payment systems used for the booking and we do not normally receive or store your full payment card details.

29. If part of these terms is unenforceable

If a court or other competent authority finds that any individual provision of these terms is unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.

Nothing in these terms affects rights that you have under applicable consumer law.

30. Governing law and jurisdiction

These Booking Terms & Conditions and the contract between you and Hush Holiday Ltd are governed by English law.

If you live in England or Wales, proceedings relating to the booking may be brought in the courts of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also have the right to bring proceedings in the courts of the part of the United Kingdom in which you live.
